Refund and Cancellation Policy

This Refund and Cancellation Policy ("Refund Policy") is part of, and incorporated into, the Stromatic Media Terms of Service. Capitalized terms used but not defined here have the meaning given in the Terms of Service.

Plain-language summary (non-binding): All sales are final. We do not issue refunds, credits, exchanges, or partial refunds, except in the narrow circumstances described below or where required by non-waivable law in your jurisdiction. Please read carefully before placing an Order.

1. All Sales Are Final

1.1 By placing an Order with Stromatic Media, you acknowledge and agree that the Order is final and non-refundable upon successful payment processing.

1.2 Our offerings consist of custom digital goods and services produced specifically in response to your Brief. The Brief is treated as immediately released for production upon payment. Custom digital goods, once produced and delivered, cannot be "returned" in any meaningful sense. You waive any statutory right of withdrawal, cooling-off period, or cancellation right that may otherwise apply to the extent such waiver is permitted by applicable law.

1.3 No refund will be issued, in whole or in part, for any of the following reasons (this list is illustrative, not exhaustive):

(a) you changed your mind, lost interest, or no longer want the Deliverable;

(b) you do not like the style, tone, color, layout, fonts, composition, or other aesthetic aspect of a Deliverable;

(c) you believe the Deliverable does not match your subjective expectation;

(d) the Deliverable was produced wholly or partly using automated, algorithmic, generative, or computational tools, or any third-party platform or service;

(e) you would prefer a different production method;

(f) the Deliverable did not generate the business outcome you hoped for (e.g., increased traffic, sales, leads, conversions, search ranking, brand recognition, customer engagement, profitability, or any other commercial result);

(g) you did not use, deploy, open, or download the Deliverable;

(h) you forgot about your Order;

(i) you cannot find or have lost the delivery email or files;

(j) the Deliverable arrived later than the estimated turnaround;

(k) you provided inaccurate, incomplete, vague, contradictory, or unusable Brief information;

(l) you changed the requirements of your business or brand after placing the Order;

(m) you discovered after placing the Order that the Deliverable is not eligible for trademark, copyright, or other registration in your jurisdiction;

(n) a third party objects to, opposes, or challenges your use of the Deliverable;

(o) you receive similar or competing services elsewhere;

(p) you experience financial hardship;

(q) the price of the same Service later changes; or

(r) any other reason not expressly listed in Section 2 below.

2. Limited Exceptions

The following are the only circumstances in which we will consider issuing a refund:

2.1 Order cancelled by us before delivery

If we cancel an Order in our sole discretion before any Deliverable is produced or delivered, we will refund the amount paid for that Order. This is your sole and exclusive remedy in such case.

2.2 Duplicate or technical-error charges

If you were charged more than once in error for the same Order due to a verifiable technical malfunction of our payment flow, we will refund the duplicate charge upon verification. Currency-conversion differences charged by your bank or card issuer are not duplicate charges and are not refundable.

2.3 Non-waivable statutory rights

If applicable law in your jurisdiction grants you a non-waivable refund or cancellation right that applies despite Section 1, we will honor it to the extent required. The existence and scope of any such right depends on your jurisdiction and the specific circumstances.

2.4 Discretionary good-will adjustments

We may, in our sole discretion and on a case-by-case basis, offer a credit, partial refund, or remake. Any such accommodation is a one-time good-will gesture, is not a precedent, does not amount to admission of liability, and does not modify this Refund Policy or the Terms of Service.

3. No Cancellation After Payment

3.1 Once payment is confirmed by our payment processor, an Order cannot be cancelled by you. The Brief is treated as released for production immediately, regardless of whether production has measurably commenced.

3.2 If you wish to abandon an Order after payment, you may do so, but no refund will be issued and the Deliverable will still be produced and delivered to the email address provided at checkout.

4. Acceptance and Delivery

4.1 A Deliverable is deemed accepted upon transmission to the email address provided by you at checkout, regardless of whether you open, download, view, or use the Deliverable, and regardless of whether the email is filtered to a junk, spam, promotions, or other folder by your email provider.

4.2 You are solely responsible for providing a working, monitored email address; ensuring that your inbox is configured to receive messages from our sending domain; and checking spam, junk, and promotions folders. Failure to receive or locate a delivery email due to your email configuration, full inbox, blocked sender, address typo, or third-party email-provider behavior is not a basis for refund.

4.3 If you have not received delivery within seventy-two (72) hours after the estimated turnaround, contact us at the address in Section 8 and we will use reasonable efforts to re-send. Failure to receive delivery alone is not, in itself, a basis for refund as long as we are able to re-deliver upon notice.

5. Method, Quality, and Outcome Disclaimer

5.1 You acknowledge and agree that:

(a) Stromatic Media may use any combination of human work and Third-Party Tools (including automated, algorithmic, generative, or computational systems) to produce Deliverables, in its sole discretion;

(b) the production method is not material to the agreement and is not a basis for refund or dispute;

(c) Deliverables are creative or analytical works whose value is inherently subjective; and

(d) Stromatic Media makes no representation or warranty as to outcome, performance, registrability, distinctiveness, originality, search-ranking improvement, conversion, or any other commercial result.

5.2 Sections 10 (Disclaimers), 11 (Limitation of Liability), and 12 (Indemnification) of the Terms of Service apply to this Refund Policy and limit any remedy available to you in connection with an Order.

6. Chargebacks, Disputes, and Reversals

6.1 You agree to contact us first, at the email address in Section 8, before initiating any chargeback, payment-card dispute, or reversal. Most concerns can be addressed without involving the card network, and initiating a chargeback prematurely makes resolution slower and more costly for both parties.

6.2 Initiating a chargeback, dispute, or reversal without first attempting good-faith resolution with us constitutes a material breach of the Terms of Service and this Refund Policy. In such event, we reserve the right to:

(a) submit evidence to the payment processor and card network demonstrating Order placement, your acceptance of the Terms of Service and this Refund Policy, fulfilment of the Order, and your agreement to the no-refund and pre-dispute-contact provisions;

(b) recover from you the disputed amount, plus any chargeback fees, processor fees, legal fees, collection costs, and other expenses we incur, by any lawful means including referral to a collections agency or legal action;

(c) suspend or terminate your access to the Service and refuse all future Orders;

(d) pursue any other remedy available at law or in equity; and

(e) treat the dispute under the Mandatory Arbitration provisions of the Terms of Service.

6.3 Filing a fraudulent chargeback (e.g., claiming a transaction was unauthorized when it was authorized; claiming a Deliverable was not received when it was delivered to your provided email) may constitute fraud under applicable law and may be reported to relevant authorities.

7. Currency, Taxes, and Fees

7.1 Refunds, when issued under this Refund Policy, are made in the currency originally charged, by the original payment method, less any non-recoverable processor fees, currency-conversion differences, or chargeback fees.

7.2 We are not responsible for currency-conversion losses, foreign-transaction fees, or any other fee charged to you by your bank, card issuer, or payment provider.

7.3 If you were charged tax that is non-refundable to us, we will refund only the portion we are able to recover.

8. How to Contact Us About a Refund Inquiry

If you believe one of the limited exceptions in Section 2 applies to your Order, contact us within fourteen (14) days of the Order date with:

(a) your full name;

(b) the email address used at checkout;

(c) the date of the Order;

(d) a clear description of the basis for your inquiry; and

(e) any supporting information.

9. Changes to This Refund Policy

We may revise this Refund Policy from time to time. The "Last Updated" date at the top reflects the most recent revision. The Refund Policy in effect at the time of your Order governs that Order.

By placing an Order with Stromatic Media, you acknowledge that you have read and understood this Refund Policy and agree that all sales are final, subject to the limited exceptions above and any non-waivable statutory rights.
